Measure 114, which was passed by Oregon voters in November 2022, was struck down by Harney County Judge Robert Raschio during a hearing in Burns on Tuesday, Nov. 21, 2023.

The measure required those wishing to purchase a firearm to obtain a permit from local law enforcement. In order to obtain a permit, they would have to pay a fee, show a photo ID, get fingerprints, complete safety training, and pass a criminal background check. The measure also prohibited magazines holding more than 10 rounds of ammunition.

Judge Raschio concluded that, “This court is preventing the undue burden of Ballot Measure 114 from being imposed on current, and prospective, gun owners who have a right to lawfully possess firearms for the purposes of defending themselves and the state against imminent threats of harm.” He went on to say that, “The court, using its equitable power, declares and adjudges Ballot Measure 114 facially unconstitutional in all of its applications under Oregon Constitution, Article I, § 27.”

In an emailed statement, Oregon Attorney General Ellen Rosenblum said, “The Harney County judge’s ruling is wrong.”

Rosenblum has promised to appeal the case.

Judge Raschio’s block of Measure 114 took effect on Dec. 8, 2023.
