Judge Raschio delays signing Measure 114

Harney County Circuit Court Judge Robert Raschio says he will delay signing Measure 114 until after a Jan. 2 hearing, and will consider the state’s challenges. 

The state is objecting that:

• the Court’s finding that the Federal Bureau of Investigation will not conduct background checks;

• the Court’s finding that the parties “agreed” that Measure 114 “delays the purchase of firearms for a minimum of 30 days;”

• the Court’s findings that State Defendants failed to present public safety evidence;

• State Defendants object to the Court’s findings regarding ownership of firearms;

• State Defendants object to the Court’s finding that the media sensationalizes mass shootings;

• State Defendants object to the Court’s finding that “almost all emigrants to the Oregon Territory had firearms;”

• State Defendants object to the Court’s finding that the “a magazine is a necessary component of a firearm.”

Judge Raschio ruled in November, that the measure violated that state’s constitution.
